1. Acceptance of Terms

By downloading, installing, or using the SameSecond mobile application or website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes your acceptance of the revised Terms.

2. Description of the Service

SameSecond is a mobile application that displays real-time world statistics including population, births, deaths, CO2 emissions, economic indicators, and other data. The Service is provided "as is" and is intended for informational and educational purposes.

The real-time counters displayed in the app are mathematically extrapolated estimates based on authoritative annual rate data. They are not live sensor readings and should not be relied upon for scientific, legal, or financial decisions.

3. Eligibility

You must be at least 13 years of age (or the applicable minimum age in your country) to use the Service. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.

4. Free and Paid Features

The core features of SameSecond are available free of charge. We offer an optional paid subscription called "SameSecond Pro" which unlocks additional features including access to all 180+ stat cards, unlimited quiz access, full country explorer, side-by-side comparison, and an ad-free experience.

Subscriptions are billed through the Apple App Store or Google Play according to your chosen billing cycle. Prices are displayed prior to purchase and may vary by region.

5. Subscriptions and Billing

• SameSecond Pro subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period.
• You can manage and cancel your subscription at any time through your App Store or Google Play account settings.
• No refunds are provided for partial subscription periods, except where required by applicable law.
• A free trial may be offered to new subscribers. Unused portions of a free trial are forfeited upon purchase of a subscription.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
• Reverse engineer, decompile, or disassemble any part of the Service
• Attempt to gain unauthorized access to any part of the Service or its related systems
• Reproduce, distribute, or create derivative works based on our content without written permission
• Use automated means to scrape, extract, or collect data from the Service
• Interfere with or disrupt the integrity or performance of the Service

7. Intellectual Property

All content, design, graphics, logos, and code within the Service are the property of SameSecond or its licensors and are protected by applicable intellectual property laws. The SameSecond name, logo, and brand elements may not be used without our prior written consent.

Statistical data displayed in the app is sourced from third-party institutions (World Bank, UN, WHO, Global Carbon Project, etc.) and remains subject to those institutions' own terms of use.

8. Data Accuracy and Disclaimer

While we make every effort to source accurate and up-to-date information, SameSecond makes no warranties or representations regarding the accuracy, completeness, or reliability of any data displayed in the Service. The real-time counters are estimates and may not reflect exact real-world figures at any given moment.

The Service is provided for general informational and educational purposes only. Do not rely on it for medical, legal, financial, or scientific decisions.

9. Limitation of Liability

To the maximum extent permitted by applicable law, SameSecond and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of or inability to use the Service.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us (if any) in the twelve months prior to the claim.

10. Indemnification

You agree to indemnify and hold harmless SameSecond and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, without notice. You may discontinue using the Service at any time. Upon termination, your right to use the Service ceases immediately.

12. Third-Party Services and Links

The Service may reference or link to third-party websites or services. We do not endorse or take responsibility for the content, privacy practices, or terms of any third-party services. Your use of third-party services is at your own risk and subject to their terms.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of the jurisdiction where SameSecond operates, as appropriate.

14. Severability

If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SameSecond with respect to the Service and supersede any prior agreements.
